Compliance Requirements

APPLICABILITY

Enhanced Vapor Recovery (EVR) is required for gasoline dispensing facilities with underground storage tanks that are already required to have a vapor recovery system. Air districts that are in attainment with the state ozone standard are exempt from most EVR requirements. Air districts that have recently been designated as non-attainment areas, may have different EVR deadlines than those provided here. Check with your local air district to determine the vapor recovery requirements for your facility.

EVR Phase II Vapor Recovery

EVR Phase II is required NOW for new installations or existing facilities that undergo a "major modification". The final EVR PHASE II compliance deadline was APRIL 1, 2009

April 1, 2011 - For facilities with an annual throughput of 240,000 gallons of gasoline or less AND located in Alpine, Lassen, Modoc, Plumas or Sierra County.

July 27, 2011 - For facilities located in San Luis Obispo and Siskiyou Counties.

In-Station Diagnostics (ISD)

ISD requirements depend on the annual gasoline throughput.  GDFs with an annual gasoline throughput of greater than 1.8 million gal/yr were required to have ISD by September 1, 2009.  GDFs with an annual gasoline throughput of greater than 600,000 gal/yr were required to have ISD by September 1, 2010. 

 

Those GDFs with a certified Phase II EVR system that has a certified ISD that did not meet the ISD installation deadline have until March 1, 2011 to install the certified ISD system.  Those GDFs with a certified Phase II EVR system that does not have a certified ISD system that did not meet the ISD deadline have within three months from the date when the ISD system is certified to complete their ISD installation.

Enhanced Vapor Recovery (EVR) is required for gasoline dispensing facilities with underground storage tanks that are already required to have a vapor recovery system. The deadline to comply with EVR requirements is April 1, 2009.

There are Four Steps that your station will need to complete in order to meet the EVR compliance requirement.

 

Step 1 - Evaluation Phase

Estimated Time:  2 weeks


The steps below are normally conducted by the station owner.  Operators of franchise stations may be directed to use a company contractor for these activities.

Evaluate your station situation using the following resources:

1. Read the EVR Phase II Executive Orders http://www.arb.ca.gov/vapor/eo-evrphaseII.htm, and Advisories http://www.arb.ca.gov/vapor/advisories/advisories.htm.

2. Contact your local AQMD to determine EVR compliance requirements.

3. Conduct site analysis. Look at what you have and what you need, and then determine which EVR upgrade that is right for you. You may wish to consult a certified contractor (see Step 3 - Installation Phase).

Step 2 - Permit Phase

Estimated Time:  3 to 4 months (longer in some areas)

 

Consider enlisting services to complete the permitting process such as a Permit Expeditor. Some contractors have designated staff to coordinate and complete the permit application process. Architects and engineers can also assist in the permit application process.

These projects will require a site specific engineers drawing. These are submitted as part of a plan review in order to obtain the necessary permits from local planning and building departments. In many cases, structural calculations for the concrete pad must also accompany applications for permits. Please check with your local agency.

In addition to a permit from your local AQMD/APCD, you may be required to obtain a permit or a sign-off from:

Local City/County Planning Department

Local Building Department

Local Fire Department

Local Air Quality Management District (AQMD or APCD)

Local Environmental Health or CUPA (Certified Unified Program Agency)


Other sign-offs may include:

Encroachment Permits
Variances to local set-back ordinances

Step 3 - Installation Phase

Estimated Time:  2 weeks to 1 month

Step 4 - Start-Up/ Testing/ Inspection Phase

Estimated Time:  2 weeks

 

It is likely that for each permit that is obtained, a final inspection/sign-off will be required. In many cases, there is a proper sequence to the permit sign-offs. Please check with the local agencies in order to coordinate.
